What Can I Claim For My Injuries?

You can claim for three different kinds of personal injuries under Virginia law.

• Economic damages — medical bills, future medical care, lost wages and lost earning capacity. No statutory cap in a personal injury case.
• Non-economic damages — pain, suffering, disfigurement and loss of enjoyment of life. Also uncapped in a personal injury case.
• Punitive damages — awarded to punish rather than compensate. Capped at $350,000 by Va. Code § 8.01-38.1, and available only where conduct was willful, wanton or malicious.

What Are the Rules in Virginia Surrounding Personal Injury Claims?

Deadlines to File a Claim

Virginia gives you two years from the date of your injury to file a personal injury lawsuit, under Va. Code § 8.01-243.

Filing means submitting a lawsuit to the court. It does not mean calling a lawyer, and it does not mean sending a demand letter to an insurer.

There are situations in which the two year deadline may vary:

• Injured children have until their eighteenth birthday before the period begins to run, under Va. Code § 8.01-229.
• Claims against a Virginia city, county or state agency work the other way and move faster: notice must be given within one year under Va. Code § 8.01-195.6.

Contributory Negligence

Virginia is one of a small number of states that applies pure contributory negligence. What does that mean?

It means if you are found even slightly at fault for the accident, you may not be able to recover any damages. This is why insurers in Virginia work extra hard to pin a fraction of the blame on the injured person.

That rule changes how you should handle the insurance company.

An adjuster who calls you in the days after a crash is building a record. A recorded apology, a guess at your speed, a casual "I didn't see him" or a shrug about whether you were looking at your phone can each be used to argue contributory fault.

You are not required to give the other driver's insurer a recorded statement. We recommend that you avoid giving a statement and refer the insurer to your attorney.
